Internship Agreement Luxembourg

April 10, 2021

In general, most job opportunities are provided by the financial sector thanks to the presence of many local and international banks in the country. But while you`re looking for an internship, you can also browse offers on the Internet, especially on specialized websites and social networks. Practical internships may not last more than six months over a period of twenty-four months with the same internship facilitator. However, if the internship is exceptional for the intern and does not last more than three months per year, the trainee must be affiliated only for accident insurance in the workplace. However, if the internship lasts more than three months, it should be affiliated with health, retirement and accident insurance for the duration of the internship. In this case, compliance with the above conditions is the subject of a certificate requested by the Minister of Employment to the student who submits the agreement before the start of the internship. Ministerial certification is considered an exemption from the duty of remuneration of the trainee. The remuneration of the internship depends on the duration of the internship: the employer who wishes to host an intern must take out an internship contract or an internship contract (regulated internship). Representatives were able to agree on friday morning on the laws on internships in Luxembourg. This type of internship is therefore not authorised by a Luxembourg or foreign educational institution. It is important to note, however, that the student must be registered in a Luxembourg or foreign educational institution and must attend regular studies.

In the case of a part-time internship contract, the maximum duration of the internship is calculated in hours, the remuneration provided for is proportional. The remuneration of these internships is optional if their duration is less than 4 weeks and represents at least 30% of the social minimum wage for unskilled workers for internships of four weeks or more. Therefore, the remuneration of a student employed for a period of less than 4 weeks is not mandatory and is therefore granted solely at the discretion of the company and according to internal criteria established for this purpose. Schools and universities are increasingly hosting training courses (internships) in their teaching programmes. It allows students to discover professional work environments and gain their first professional experience. The trainee must be insured for the risk of an accident. Health insurance registration procedures for in-kind benefits, reimbursement of medication or coverage of hospital costs depend on the nature of the internship and the intern`s personal circumstances. These rules do not apply to compulsory internships during a school or university course. It should be noted that any practical internship for the acquisition of professional experience must be the subject of an internship contract signed by the trainee and, if he is a minor, by his legal representative and by the intern`s guardian. This internship contract must contain certain mandatory references under Section L. 152-7. labour code.

The number of internships should be limited to 10% of the company`s total staff.
